Applying for an Australian partner visa is one of the most significant steps you and your partner will take together. At Stojanovic & Associates, we've helped hundreds of couples successfully navigate the process - whether you're applying from within Australia or overseas. With 183 five-star reviews and over 15 years of experience, you're in the right hands.

Which Partner Visa Do You Need?

There are three Australian partner visa pathways - the right one depends on where you and your partner are when you
apply.

Subclass 820 / 801 - Onshore Partner Visa

For couples where the applicant is already in Australia. You apply for the temporary 820 visa first, then transition to the permanent 801 visa.

Subclass 309 / 100 - Offshore Partner Visa

For couples where the applicant is outside Australia at the time of application. The 309 is temporary, transitioning to the permanent 100 visa.

Subclass 300 - Prospective Marriage Visa

For couples who are engaged but not yet married. This allows your partner to travel to Australia to get married, after which you can apply for the partner visa.

Am I Eligible to Sponsor My Partner?

To sponsor your partner for an Australian partner visa, you must be:

  • An Australian citizen, permanent resident, or eligible New Zealand citizen

  • 18 years of age or older

  • In a genuine, ongoing relationship — married or de facto (12+ months, or registered)

  • Not subject to a sponsorship bar from a previous application

We can help you build a strong case with the right documentation and relationship evidence.

What Evidence Do You Need?

The Department of Home Affairs assesses your relationship across four categories:

  • Financial — joint bank accounts, shared bills, joint assets or liabilities
  • Social — photos together, statutory declarations from friends and family, joint social media
  • Household — shared address, joint lease or mortgage, shared day-to-day responsibilities
  • Commitment — communication history, knowledge of each other's background, future plans together

Every couple's evidence looks different. Our job is to help you present yours in the strongest possible way.

How Long Does It Take?

Partner visa processing times vary. As a general guide:

  • Subclass 820 (onshore temporary): 12–24 months
  • Subclass 309 (offshore temporary): 12–24 months
  • Permanent stage (801/100): assessed after 2 years from initial application

Processing times change regularly. We keep clients updated throughout the process.
