We had a client who could not fulfil the requirements to obtain permanent residency on the business visa as he was at the tie on a temporary business visa. He really had no other options due to lack of English and skills. After assessing his situation and his whole family, we realised that as his daughter who was 16, played handball for an association, the family could possibly make an application for permanent residency visa with her as the main applicant for a Distinguished Talent Visa. Unfortunately, because she was under 18 we had to prove exceptional circumstances and as we were unable to get a letter from the Olympics committee the visa was rejected. We took this to the Migration Review Tribunal and what usually takes at least 12 months for the Tribunal to process the cases, we managed to get it processed in 2 months as we had good grounds for priority. The Tribunal Member was satisfied with our paperwork that the family was not even called to attend the Hearing and give evidence. In the Tribunal Member’s decision he stated that “you do not need to be god to get this visa”. The whole family got permanent residency because of their 16 year old daughter.

Unfortunately, laws change all the time and sometimes this could either increase your chances to make an application or decrease them. For one if our client’s if we did not lodge his visa in 2 days from when he first came to us he would not have a chance for permanent residency for another two years. We worked day and night to make sure our client did not miss the date and personally went to lodge his application at the Department of Immigration & Citizenship. His visa was approved in 3 weeks.

We have prepared and lodged a Carer Visa for a client who has had 7 visa rejections previously. As a result of this, this played a factor in having the visa we prepared refused. We then took this to the Migration Review Tribunal and the Tribunal Member overturned the decision and believed that our client satisfies the requirement of a Carer. Sometimes it is worth taking the matter to the tribunal if eligible as if you have an immigration history of too many applications this can affect any future applications.

This was approved with no interview stage and visa approved in just under 3 weeks.
We have also prepared Partner Visas for clients who have had criminal records and had their visa approved.We have had a client who had a previous agent acting for her in the Partner Visa Application. The relationship broke down and the agent advised her she had to go back to her country and was not eligible for any other application. The agent then acted for the Sponsor to deport her. When our clit came to us and after our consultation we were of the view that she was eligible to make an application. Our client was 75, had no English nor work experience. The laws changed which impacted one of our client’s who made an application by herself. The occupation she nominated was in the Priority 5 Category which meant it could take years before her application would get assessed. We managed to change her occupation using the information she already had provided to get her put into Priority 1. Her visa was approved 3 weeks later.

This visa is a permanent visa and is for you if you can prove you have an internationally recognised standing (achievements) and are still active in one of the following fields:

- A profession
- Academia and research

There are three types of visas which are assessed based on points:
- Independent Skilled Visa (189)
- Skilled Work Regional Visa (State and Family Sponsored) (491)
- Skill Nominated Visa (State and Family Sponsored) (190)
A minimum of 65 points is required to lodge a valid expression of interest and to be considered. Although, the higher the points, the more chances for an invitation to apply for the visa.
When applying for State Sponsorship, it is important to note that each State has their own requirements which need to be satisfied in order to obtain an invitation to apply for a visa.
